Roger Severino: Transgender Abolitionist

The newest Director of the Office of Civil Rights does not believe transexual people should exist, legally speaking. He has even gone as far as laying out the steps Congress would need to take to do so. One word is his lifeline to a transexclusive paradise.

Sex.

Severino states the word “sex” in the Constitution – specifically in regards to civil rights, education, and the ACA – does not mean “gender identity”. He is “disappointed” with his former colleagues at the Civil Rights Division of the DOJ because they “know very well” when Congress banned discrimination ‘on the basis of sex’ in 1964 and 1972, it did not mean ‘gender identity’ it simply means “a label a person is assigned at birth.”

According to Severino, the Radical Left is to blame. “The Radical Left is using government power to coerce everyone, including children, into pledging allegiance to a radical new gender ideology over and above their right to privacy, safety, and religious freedom.”

In three steps the Radical Left’s LGBT agenda to elevate the transgender to a protected class can be abolished completely. (I am of the opinion that Severino has failed to realize if the T is abolished, the remaining LGB and their “radical agenda” would remain. I wonder if he thinks they are all just going to go back into a closet somewhere?)

1. Congress could clarify that all federal laws that refer to the “sex” of a person could not be used to mean “gender identity” by any court or federal agency- unless Congress grants an authorization to do so. (You need a note from Congress to be transexual.)

2. Congress could apply this very specifically to Title IX of the Education Amendments of 1972, Title VII of the Civil Rights Act of 1964, and Section 1557 of the Affordable Care Act. These apply to protection for transgender people in regards to access to federally funded education, the right to work, and access to healthcare that receives HHS funding. (Transexuals will not have protection from discrimination by the DOE, DOJ, DHHS, or the EEOC.)

3. Congress could specify that the Departments of HHS, Education, Justice, along with the EEOC would be prohibited from using any federal funds to implement or enforce new administrative transgender directives or regulations against those who do not comply. In addition, these agencies can not revoke federal funding for non-compliance with the administration’s directives. (DHHS, DOE, DOJ & EEOC will not pay to implement or enforce, or be penalized for not implementing or enforcing, the new administration’s directives.)

Roger Severino has  built a career out of forcing people to fight to prove they deserve to exist. Now he has concocted a scheme to both disable the existing transgender population of our country and simultaneously discourage new attempts to transition in the future.  There was a time in this country when only white men had rights, and now they are coming to take them back. Exclusion by difference is segregation. Remember segregation?

I didn’t know he existed before last night. He has been helping to hobble the efforts of every single activist, protestor, lobbyist, legislator, and basic label-less human who has championed for transexual rights – ever – since the fight began. If you aren’t a white (cisgender, of course) man, you can be “excluded” from every civil right amendment we have.  Abolition of transgender identities legally is just the tip of the iceberg. A lot of humans have fought and won the right to be a human worthy of services. It is time to make sure you know what you’re facing.
